2. Have you or your spouse lived in Maricopa County for the past 90 days?

3. Is your marriage irretrievable broken with no reasonable prospect of reconciliation?

4. Are you aware that there are court reconciliation services and do you agree that they cannot save your marriage?

Did you answer YES to all the questions? If so, you qualify for divorce in Maricopa County. Proceed to the fee agreement at the bottom of the page.

STEP 1: FEE AGREEMENT

Limited Scope Fee Agreement

This memorandum is to confirm that you have retained BEST LAW FIRM to draft your legal documents 
outlined below. This agreement takes effect as soon as the client signs the agreement 
electronically by clicking; “Yes, I qualify and agree to the above fee agreement” and submits 
it to the law firm with the  appropriate fee, and upon the law firm agreeing to the representation 
by signing and transmitting a copy of the agreement to client.

This FLAT FEE AGREEMENT (no hourly fees will be charged)  is as follows:

Scope of Work.

We agree to : Draft your documents upon our receipt of your completed The Divorce Coach 
Questionnaire, which will be sent to  you upon “signing” the fee agreement and 
receiving your payment  (check the one that applies)” 
1.	Divorce with children: $595
2.	Divorce without Children: $495
3.	Separation with children: $595
4.	Separation without children: $495

There is a court filing fee of $321 that you must pay directly to the County. 
      
This flat fee includes:

1.	Upon receipt from client of The Divorce Coach Questionnaire (sent to 
you by the method you select), the law firm will prepare court papers 
and transmit them to you (expected turnaround time is 24 business hours or 
less). 
2.	This packet of documents described above can then be filed at one of the 
four courthouses in Maricopa County or the county in which you 
reside.  CLIENT IS RESPONSIBLE FOR THE COURT FILING 
FEE WHICH IS $321.00 IN MARICOPA COUNTY, payable at the 
time the court papers are filed. 
3.	Provide you with 1 free phone consultation up to 1 hour with an 
attorney. We would like a call immediately upon you sending 
in the questionnaire and will schedule a consultation immediately if 
possible or within 24 business hours. 
4.	We will return the completed documents to you for filing in the court or 
for an additional fee, Best Law Firm will file the documents for you 
and return the stamped copy to you in the mail. If you choose to 
file them on your own, Best Law Firm will provide you with 
instructions on how to file them. 
5.	We will not serve the documents for you unless you have chosen that 
option described above and paid an additional fee. 
6.	We will draft these documents in your name and we will not be filing a 
notice of appearance nor do we agree to represent you in court.
7.	Our representation ends when the work described above is complete
8.	Our fee is earned upon receipt. 
      
      
Limitations: We will not represent you for any appeal, any tax or QDRO issue. 
Our representation is contingent on your compliance with the remainder of this fee 
agreement. We will take no other action on your behalf except those described above. 
We rely on your representation of the facts as outlined in your questionnaire. Best Law 
firm will only represent the client, not the spouse. We are unable to engage in additional 
phone calls or emails with you after your 1 free consultation. We do provide 
legal consultations for a minimum of $200 per hour, payable at the time of the consult. 
This is often a very efficient way for you to receive specific legal advice for your case. We 
will not talk with opposing counsel nor will we talk with your spouse. We reserve the 
right to withdraw from the representation if client does not return the Divorce Coach 
Questionnaire within 7 days of receiving it. 
    
Other Document Preparation: As your matter progresses, we are available to 
draft other documents that you will need to complete your divorce. These services can 
be purchased on a flat fee basis and these services and fees can be discussed with the law 
firm since they vary depending on the complexity.  They will require a separate one page 
fee agreement that incorporates by reference this fee agreement. 
      
Conflict: If we receive two payments and two questionnaires from married spouses, we will 
enter into a fee agreement with the first spouse only and refund the money to the second 
spouse without reading the questionnaire answers. We will be entitled to read the 
identifying information on every questionnaire in order to determine any conflicts. If 
client believes there is a conflict because of contact with spouse, client has a duty to 
notify law firm immediately of the potential conflict or it is deeded waived. Best Law Firm will 
only represent one side in a family law matter as an attorney. Best Law Firm will immediately 
withdraw from this scope of work outlined in the fee agreement upon receipt of 
information of a conflict or potential conflict.  Best Law Firm uses its best efforts to avoid 
conflicts and potential conflicts with a  conflict check upon receipt of your initial client 
information written on the top of the Divorce Coach TM Questionnaire. If two questionnaires
are received by two married spouses, Best Law Firm will withdraw immediately and refund the
payments. 
      
The most important concept in this letter is that we will do our best to serve you 
effectively. While we cannot guarantee or predict any result, we will strive to represent 
your interests honorably and efficiently. 
      
Refunds: Once The Questionnaire has been sent to you, there are NO refunds. It is 
considered earned upon receipt once the Questionnaire has been sent to you.

Taxes: We do not provide tax advice. Please seek the advice of a competent 
tax advisor.

Third Party Payor: If your legal fees are being paid by a third party, both you 
and the third party must understand that our ethical duties of confidentiality and 
communications are owed to you, not to the person paying the fees. All decisions 
regarding the legal status and strategy of your case shall be discussed with you unless you 
give us express [written?] permission. Any refund shall be returned to the party who 
provided the funds.

Document Retention: We will keep the electronic  documents related to your 
file for 5 years and you agree the file may be destroyed in accordance with the State Bar 
ethical rules. We never want any originals of any document. The Firm will deem Clients’ 
acknowledgment of our engagement as an assent to the handling of Clients’ documents 
in this manner.

No Advice Regarding This Fee Agreement: The Firm is not acting as your 
counsel in advising you with respect to this letter, as the Firm would have a conflict of 
interest in doing so. If you wish to be advised by independent counsel, we recommend 
that you consult with independent counsel of your choice. In addition, if you have 
questions or would like additional information, we would be happy to discuss the matter.

Disputes: Any controversy, dispute, or question arising out of, in connection 
with, or in relation to this Agreement or its interpretation, performance, or any breach 
thereof, shall be determined by arbitration conducted in Phoenix, Arizona and in 
accordance with the then-existing rules of the State Bar of Arizona Fee Arbitration 
committee. Any decision rendered by the Arbitrator shall be final and binding upon the 
parties and judgment upon any arbitration award, including an award of damages, may be 
entered in any court having jurisdiction thereof. The Arbitrator may not amend, modify, 
or substitute any of the terms or conditions of this Agreement and his/her jurisdiction is 
thereby limited. If any party to this Agreement refuses to arbitrate it, then the other party 
may seek an order in the Maricopa County Superior Court ordering such arbitration. In 
essence, this provision causes you to waive the right to a jury trial, and we urge you to 
consult with an independent lawyer about such a waiver. The Firm may employ counsel 
to resolve any disputes and if there are fees awarded, Best Law Firm has the right to 
employ attorneys within the firm to handle the legal matter and obtain fees if awarded 
for their work to enforce this agreement.
